Steeped App (hereinafter: "App") is an application of Steeped Software Germany GmbH, Breite Str. 46, 76467 Bietigheim, HRB 738189, represented by Mr Janek Wunderlich, Mr Marcel Bechler and Mr Tristan Otto (hereinafter: "Steeped", "we/us") providing Users with information about different sorts of tea and their preparation. By using this App, you (hereinafter: "User") conclude a Use Agreement with us that is subject to the following terms and conditions.
§ 1 Subject matter of the Agreement
Steeped shall make available the most current version of the App to the User and grant the User a non-exclusive and perpetual licence to use the App in the form of an object code for installation and use. The User may not violate the contractual provisions or applicable law. Moreover, the User must refrain from taking any action that affects or could affect the availability, integrity or authenticity of our App.
§ 2 Provision of the App
The App is made available by us for free download in the app stores: "App Store" (iOS) and "Google Play Store" (Android). Any delays in the provision of the App by the respective app store are beyond our responsibility and, therefore, do not justify any claims of the User against us or any right of the User to terminate the Agreement.
§ 3 Fee
The use of the App is free of charge.
§ 4 Warranty
Steeped warrants that the App – at the time of its provision – is made available in a condition corresponding to the contractual condition and that its use by the User in the contractually agreed scope in the country of first acquisition of the App is not hindered by any third party rights. After lapse of one year since the App was made available, this shall only apply if the User proves that the App had not been in the contractually agreed condition at the time of its provision.
Steeped shall provide information about updates to the App on its website, accessible under https://steeped.app, in the app stores and in social media channels and make them available for download there. The User is free to download and install the respective update. If the User does not install the updates made available by us, Steeped shall not be liable for any deviations from the contractually agreed condition of the App that result from the failure to install the respective update.
§ 5 Liability
Steeped shall be liable, also for actions of its legal representatives and vicarious agents, without limitation only in the event of:
intent or gross negligence,
injury to life, limb or health,
within the scope of a guarantee assumed by us, and
under product liability law.
Steeped's liability for slightly negligent violation of any obligations that are vital for achieving the purpose of the Agreement shall be limited only to the amount of damage being foreseeable and typical of that kind of business. Steeped shall not be liable in any other cases.
§ 6 Miscellaneous
Since the App is made available free of charge, the User has no right to cancel the purchase.
This Use Agreement shall be governed by the laws of the Federal Republic of Germany.
Should individual provisions of these terms of use be or become invalid and/or be contrary to statutory regulations, the effectiveness of the remaining terms of use shall remain unaffected.
